Thousands of individuals are pursuing legal recourse against Johnson & Johnson, alleging that their talcum powder usage led to cancer development.
In the UK, around 3,000 people are taking legal action against the pharmaceutical company, claiming that Johnson’s Baby Powder sold by the company was contaminated with asbestos. The plaintiffs assert that either they or their family members contracted ovarian cancer or mesothelioma due to talcum powder usage and are now seeking compensation at the High Court in London.
Among those involved in the lawsuit is Janet Fuschillo, who disclosed that she used Johnson & Johnson’s baby powder since the 1960s and was diagnosed with ovarian cancer seven years ago. Expressing her distress, Janet, aged 75, stated that she used talc on herself and her children for almost 50 years, believing it to be pure and beneficial, only to discover potential harm associated with its use.
Legal representatives for the group alleged in court filings that Johnson & Johnson deliberately concealed the risks linked to talcum powder for years, eventually substituting talc with corn starch in the UK as of 2023. The legal team from KP Law is handling the case against Johnson & Johnson, a major talc distributor.
Responding to the allegations, a spokesperson from Kenvue, formerly part of Johnson & Johnson, emphasized that the talc utilized in baby powder adhered to regulations, was asbestos-free, and did not pose cancer risks, highlighting talc as a naturally occurring mineral sourced from the earth.
Michael Rawlinson KC, representing the claimants, argued in court documents that nearly all talc deposits exploited for commercial purposes worldwide contain asbestos, including those supplying Johnson & Johnson. He cited reports from these mines and existing scientific literature as sources that would have alerted Johnson & Johnson to asbestos contamination risks.
Despite this knowledge, Johnson & Johnson allegedly suppressed information indicating talcum powder contamination with asbestos, lobbied regulators to sustain product sales, and supported studies to downplay health hazards. Mr. Rawlinson accused the company of acting in bad faith to safeguard its brand reputation and profit interests associated with baby powder.
Mesothelioma, a cancer type primarily caused by asbestos exposure, typically forms in the lungs following inhalation of microscopic fibers, as per NHS guidelines. The case also highlighted Patricia Angell’s account of her husband’s mesothelioma-related death, underscoring the devastating impact of alleged talc exposure.
Previously, a US court ruled in favor of 22 women, ordering Johnson & Johnson to pay significant damages after they claimed to have contracted ovarian cancer from Johnson’s baby powder. In response to the ongoing legal proceedings, both Kenvue and Johnson & Johnson reiterated the safety and compliance of their talc-based products with regulatory standards.
A Johnson & Johnson spokesperson redirected inquiries to Kenvue, the former consumer health division, emphasizing that Kenvue retained responsibility for talc-related litigations post the separation from Johnson & Johnson.
